Summary Explanation/Background

At its meeting of June 10, 2025, Item No. 37, the Board directed the County Attorney’s Office to draft an Ordinance amending Section 5-187 of the Code to refine the process for the issuance of building permits prior to plat recordation. Section 5-187 authorizes the County Administrator to approve agreements for the issuance of building permits prior to the recordation of an approved plat and requires developers to provide security to cover the cost of demolishing the buildings and restoring the right-of-way in the event the plat is not recorded. As a means of streamlining the permitting process if the plat is recorded, Section 5-187 also requires the developer to post security for the infrastructure improvements that are required to support the buildings that were constructed prior to plat recordation.

 

The proposed Ordinance provides for review of the security amount by the Highway Construction and Engineering Division for work within the right-of-way, by the Building Code Division for work within the unincorporated areas, and by the applicable municipality for work within the incorporated areas.
