Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On June 10, 2025 (Agenda Item No. 2), the Board of County Commissioners of Broward County, Florida declared this parcel of real property identified by Folio Number 4842-18-01-0212, approximately 7,638 square feet, and located at Lyons Road between West Sample Road and Wiles Road in the City of Coconut Creek (the “Property”), as surplus to the County’s needs based on its unsuitability for development or building due to its size, shape, location and value; and authorized the Real Property and Real Estate Development Division to send notice to adjacent property owners of the County’s intent to sell the Property, and to manage the sale of the Property in accordance with Florida Statutes, Section 125.35(2), which allows for the conveyance of the Property at private sale without receiving bids or publishing notice if the Property is conveyed to an adjacent property owner.

As required under Section 125.35(2), on June 12, 2025, notice of the County’s intent to sell the Property was sent to the only adjacent property owner. On June 26, 2025, the County was notified in writing of the adjacent property owner’s interest in purchasing the Property for a purchase price of $50,000. Upon the closing of the sale of the Property, the adjacent property owner will grant to the County an easement throughout the Property for drainage, sidewalk and access purposes, which easement shall be recorded simultaneously with the Quitclaim Deed.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
