Board approval is required for amendments to agreements exceeding the approval authority of the Director of Purchasing, in accordance with the Broward County Procurement Code, Section 21.47.(a).

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Enterprises established County Business Enterprise (CBE) cumulative participation goal for Agreement PNC2123898P1 of 25%. Thompson and Associates, Inc., is a Broward County CBE firm, and has committed to a 60% CBE cumulative participation. Professional services under this Agreement are performed through the issuance of individual Purchase Orders and CBE participation goals apply to the cumulative total value of the Agreement. As of November 2023, Thompson & Associates, Inc., Civil Engineering has invoiced $406,619 with $119,369 paid to CBE firms, yielding 29.36% participation to date. (Exhibit 1)
On June 13, 2023, (Item No. 60), the Board of County Commissioners approved an Agreement between Broward County and Thompson & Associates, Inc., Civil Engineering for Consultant Services for Water and Wastewater Projects Regional Effluent and Reuse Solutions Category 3, Request for Proposal No. PNC2123898P1 in the amount of $4,600,000, to provide engineering, design, and construction management services for the installation of a pipeline carrying treated wastewater from the North Regional Wastewater Treatment Plant to the City of Pompano Beach Oasis Facility. (Exhibit 2)
If approved, this First Amendment provides additional consultant services in the amount of $537,600 for a total not-to-exceed amount of $5,137,600. (Exhibit 3)
