MOTION TO ENACT Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE LANDLORD REGISTRATION, MINIMUM STANDARDS, AND RESIDENTIAL RENTAL PROPERTY INSPECTIONS PROGRAM; AMENDING VARIOUS SECTIONS OF CHAPTER 39 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”), ELIMINATING THE REQUIREMENT FOR THE ISSUANCE OF A RESIDENTIAL RENTAL CERTIFICATE AND STREAMLINING THE ENFORCEMENT PROVISIONS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Board”) at its meeting of December 10, 2024.

Summary Explanation/Background
The proposed Ordinance amends various sections of Chapter 39 of the Broward County Code of Ordinance related to the Landlord Registration, Minimum Standards, and Residential Rental Property Inspections Program (“Program”) to (i) eliminate the requirement for the issuance of a paper Residential Rental Certificate and (ii) streamline the Program’s enforcement provisions.
An application for registration in the Program will be required for each residential rental unit, notwithstanding the elimination of the requirement for a Residential Rental Certificate. Moreover, the Building Code Division will continue to investigate minimum standards complaints and conduct exterior property inspections to address substandard maintenance of rental properties, promote greater compliance with property maintenance standards, protect property values, and preserve the quality of the Broward Municipal Services District neighborhoods and available housing.

Fiscal Impact/Cost Summary
Currently, the actual cost to the County for each residential rental unit registered through the Program, including the required inspection, is approximately $300. Notwithstanding, the County is currently charging only $75 per registration. The proposed Ordinance eliminates the inspection element, which will reduce the County’s costs to $75 per registration (consistent with the current fee structure). The proposed Ordinance will also result in approximately $1,928.51 in minor ancillary cost savings, including printing, mailing, and postage.
Per the Office of Management and Budget, the estimated impact on the budget does not exceed the threshold required for a Fiscal Impact Statement.
