A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Board”) at its meeting of October 7, 2025.

Summary Explanation/Background

Currently, Section 5-182.2 of the Code requires certain findings to be made in order to determine whether an application is subject to a regional road concurrency determination under Section 5-182.1(a)(4)a) of the Code. Notwithstanding, the Code provides for a de minimis exception to the adequacy determination requirement if the proposed development meets certain specified criteria, including that the development consists of one (1) single family dwelling or duplex.

The proposed Ordinance amends the Code to increase the de minimis exception to proposed developments of ten (10) or fewer single family dwellings or one (1) duplex. The proposed amendment would result in a greater number of applications satisfying the de minimis exception criteria.

 

At a public hearing held on October 8, 2025, the Local Planning Agency determined that the proposed Ordinance is consistent with the Broward County Comprehensive Plan.
