Summary Explanation/Background

PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

This item supports the Commission's Healthy Community goal of cultivating community culture, arts, recreation and life-long learning.

 

Broward County (“County”) has been receiving matching grant funds from the Children’s Services Council of Broward County (“CSC”) since 2002 for the County’s SWIM Central Program, operated by the Broward County Parks and Recreation Division, for water-safety education and instruction for County children on a reimbursement basis. In Fiscal Year 2024, the County received funding in the amount of $687,782 from the CSC, requiring a $552,349 County contribution. For Fiscal Year 2025, the CSC has appropriated $877,813 for the County’s SWIM Central Program for the period of October 1, 2024, through September 30, 2025.

 

The services to be provided by the County’s SWIM Central Program, through Broward County Parks and Recreation Division, are specified in Exhibit A - Scope of Work to the Agreement. It is estimated that this funding, along with the County contribution of $558,435 and the School Board of Broward County’s contribution of $200,000 in services, will provide water-safety education and instruction to approximately 24,700 children residing in Broward County for Fiscal Year 2025.

 

The Agreement is on a form prepared by the CSC and incorporates some recommended changes requested by the County. The CSC form agreement includes certain non-standard provisions, including the County’s obligation to indemnify the CSC for intellectual property infringement claims and a cross-indemnification provision relating to claims for violation of privacy rights (including claims brought for alleged violations of the Family Educational Rights and Privacy Act). The CSC is providing funding to the County and has requested the County execute the Agreement first. The Agreement is retroactively effective as of the first day of Fiscal Year 2025, October 1, 2024. This Agreement was not provided by the CSC until after the Fiscal Year began; however, the CSC will accept invoices for payment for any services performed after October 1, 2024.
