MOTION TO APPROVE funding increase for Agreement 24-CP-CSA-2199-01 between Broward County and Broward Behavioral Health Coalition, Inc., by reallocating unused grant funds in the amount of $231,300, increasing the Agreement’s maximum funding amount from $930,818 to $1,162,118, effective December 1, 2024, through September 29, 2025, for the provision of services to additional eligible children in Broward County; authorize the Human Services Director to execute a contract adjustment; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement as amended.
B. MOTION TO APPROVE waiver of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board member holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item: Silvia Quintana.

Why Action is Necessary
A. Broward County Board of County Commissioners (“Commission”) approval is required for agreements with external agencies.
B. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.
What Action Accomplishes
A. Approval of Motion A enables the reallocation of unused grant funds from the prior County fiscal year to maximize the provision of One Community Partnership 4 (“OCP4”) services.
B. Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The OCP4 funding assists with achieving children’s mental health wellness while keeping them in the least restrictive environment with the support and participation from their families.
On March 17, 2023, Broward County Human Services Department (“HSD”), in collaboration with BBHC, applied to the U.S. Department of Health and Human Services, Substance Abuse and Mental Health Services Administration (“SAMHSA”) for OCP4 funding. OCP4 services assist with building sustainable cross-systems infrastructure and increasing evidence-based service capacity to improve mental health outcomes for children ages four through 11 years who are at risk for or who have a serious emotional disturbance and their families with emphasis on underserved and minority populations, specifically Black and Hispanic children.
On September 14, 2023, SAMHSA issued a notice of award for the OCP4 project in the two-year grant amount of $2,000,000, effective September 30, 2023, through September 29, 2025.
On December 12, 2023, (Item No. 12), the Commission authorized the County Administrator to execute the OCP4 grant Agreement with SAMHSA, adopted the budget, and authorized the County Administrator to execute an Agreement with BBHC for OCP4 services. The two-year OCP4 project budget included an aggregate amount of $2,701,702, with a $33,702 in-kind match from Broward County and a $668,000 external match from the Children’s Services Council of Broward County added to the $2,000,000 SAMHSA grant.
On August 27, 2024, County exercised Option Period 1, commencing on September 30, 2024, and continuing through September 29, 2025.
On November 26, 2024, Broward County received SAMHSA’s approval to carry over unused OCP4 grant funds totaling $233,601 from Fiscal Year 2024 to Fiscal Year 2025 to allow OCP4 services to be provided to additional eligible children (Exhibit 1). The amount of $233,601 includes $231,300 for BBHC to provide OCP4 services to an estimated additional 30 eligible children and $2,301 of operating costs for Broward County. Upon Commission approval, the Human Services Department Director may execute a contract adjustment increasing the Agreement’s maximum funding amount for Option Period 1.
The retroactive effective date of December 1, 2024, is to allow BBHC to bill for additional eligible children receiving OCP4 services. Funds are anticipated to be used completely before September 29, 2025.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee.” In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached as Exhibit 2 and constitutes full disclosure of any existing conflicts.
