Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT/HUMAN SERVICES DIVISION/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

Part of this item relates to activities in the Broward Municipal Services District, formerly known as Unincorporated Broward County, precisely for the Edgar P. Mills Center, located at 900 Northwest 31st Avenue, Fort Lauderdale, Florida 33311. The Broward County Board of County Commissioners is the governing body of the District and provides municipal services for the area.

 

On April 17, 2007 (Item No. 8), the Board of County Commissioners approved the Facility Use Agreement between the County and the Department of Health, which facilitates the use of a County-owned facilities for community public health services. On June 10, 2014 (Item No. 5), the Board of County Commissioners approved the First Amendment to the Facility Use Agreement to update the list of County-owned facilities occupied by the Department of Health and each party’s maintenance and repair obligation. On March 1, 2016 (Item No. 4), the Board of County Commissioners approved the Second Amendment to the Facility Use agreement to extend the term of the Agreement to April 16, 2021, with two automatic, successive two-year renewals (ending on April 16th, 2025), and to update the County’s maintenance obligation. The Facility Use Agreement was amended by a Third Amendment dated June 6, 2023 (Item No. 3), and by a Fourth Amendment dated November 14, 2023 (Item No. 14), both modifying the list of facilities under the Facility Use Agreement. On June 18, 2024 (Item No. 6), the parties entered into the Fifth Amendment to account for BCHD’s planned improvements at the South Regional Health Center.

 

The proposed Sixth Amendment to the Facility Use Agreement extends the current term for an additional five years, changing the termination date from April 16, 2025, to April 16, 2030, and provides for two automatic, successive two-year renewal options, for all facilities included in Exhibit 2.

 

The Facility Use Agreement has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
