Summary Explanation/Background
On May 24, 2022 (Item No. 47), the Commission approved general guidelines for use by cities and local, state, and federal law enforcement agencies for the installation and operation of law enforcement surveillance (“LES”) systems within Broward County (“County”) right-of-way and/or attached to County-maintained traffic signal infrastructure. The Commission also approved a standard form Revocable License Agreement (“RLA”) for use between the County and the respective law enforcement agency for installation, operation, and maintenance of the LES system. The Commission authorized the County Administrator, or designee, to execute the standard form RLAs and any amendments that did not impose any additional financial burden on the County, subject to review for legal sufficiency by the County Attorney’s Office.
On November 13, 2025 (Item No. 59), the Commission approved RLAs between the County and the City of Plantation for installation, operation, and maintenance of school zone speed detection (“SD”) systems within County right-of-way at multiple locations. The Commission also authorized the County Administrator, or written designee, through September 30, 2026, to approve and execute future RLAs between the County and any municipality requesting the installation of SD systems within County right-of-way, including any amendments, provided neither the RLA nor any amendment imposed an additional financial burden on the County, and that each RLA and amendment was subject to review for legal sufficiency by the County Attorney’s Office. The Commission further directed the County Attorney’s Office to prepare an amendment to the Administrative Code delegating authority to execute future RLAs to ensure their expeditious approval after September 30, 2026.
The proposed Resolution creates Part XLIV of Chapter 31 and Section 31.124 of the Administrative Code authorizing the County Administrator, or written designee, to approve LES and SD RLAs, provided that such RLAs have been reviewed and approved for legal sufficiency in advance by the County Attorney’s Office and meet the additional requirements enumerated in the section. The County Administrator will be required to report at least annually to the Commission identifying RLAs approved and executed under the section.
