Why Action is Necessary

A. Board of County Commissioners’ (“Board”) approval is required when the FGMP exceeds the Board-approved estimated Guaranteed Maximum Price.

 

B. Board approval is required to increase the total budget of a capital project by more than 5%.

 

What Action Accomplishes

A. This action approves FGMP Contract Amendment No. 10B and establishes the total FGMP for FGMP Contract Amendment Nos. 10A and 10B for the 500-Car Secured Parking Garage and Plaza project.

 

B. Transfers one-time funds from the BCJC East Wing Renovation project to the 500-Car Courthouse Garage project to fund the project’s revised total estimated project cost.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

The Office of Economic and Small Business Development established a County Business Enterprise (“CBE”) participation goal of 30% for entirety of the agreement. To date SPJV has achieved 46% CBE participation (Exhibit 1).

 

On September 22, 2020, the County Administrator executed, through Board Action on September 10, 2020 (Item No. 59), the Agreement for Managing General Contractor with SPJV (“Construction Agreement for certain Broward County judicial projects identified in County’s solicitation PNC2119163P1.

 

On September 21, 2021, the Board approved a First Amendment to the Construction Agreement that increased the funding to the Owner’s Allowance accounts to allow the County flexibility to address fluctuations in the pricing of construction costs resulting from the ongoing pandemic.

 

On October 11, 2022, the Board approved a Second Amendment to the Construction Agreement that set the Estimated Guaranteed Maximum Price for the South Regional Courthouse Replacement Project.

 

On April 16, 2024, the Board approved a Third Amendment to the Construction Agreement that set forth specific enabling projects (“Enabling Projects”) necessary to be completed prior to the start of construction of the 500-Car Secured Parking Garage and Plaza project (“Garage Project”) and established an Estimated Guaranteed Maximum Price of $14,708,910 for the Enabling Projects.

 

On September 12, 2025, the Contract Administrator approved the first phase of the Garage Project via FGMP Contract Amendment No. 10A. The amendment permitted the procurement of long lead items and associated trades and established a FGMP of $15,130,420 for those materials and services.

 

This proposed FGMP Contract Amendment No. 10B establishes the remainder of the FGMP for the construction of the Garage Project. The negotiated FGMP No. 10B total is $51,735,776.

 

Motion A approves FGMP Contract Amendment No. 10B in the amount of $51,735,776 and establishes the total FGMP for the Garage Project as $66,866,196.

 

The FGMP Contract Amendment No. 10B will be distributed as additional material prior to the Boad meeting.

 

Motion B transfers one-time funding from the BCJC East Wing Renovation project to the Garage Project for the purpose of funding the reconciled FGMP (Exhibit 2). The proposed additional funding covers the total project budget for FGMP 10. This includes actual construction costs as well as the costs associated with increased construction time due to site conditions which necessitated revisions to the parking garage structure and plaza layout, increased floor level elevations to meet revised FEMA flood plain levels, environmental site findings, cost of services rendered by environmental consultants, design consulting team, and owner’s construction management team, permit fees, and contingencies for other unanticipated findings.

Fiscal Impact/Cost Summary

The Fiscal Year 26 Modified Budget for this project is currently $59,470,116. The balance of funds needed for the 500-Car Courthouse Garage project is $24,344,630. The additional funding is proposed to be transferred from the BCJC East Wing Renovation project to the 500-Car Courthouse Garage project to fund additional estimated costs of the project. It is anticipated that the $24,344,630 transferred for this purpose will need to be restored in a future budget action.
