Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action allows BCAD to accept grant funding from FDOT for the construction of the Project at HWO.
The total construction cost for the Project is estimated to be $2,376,105 (“Construction Cost”). As outlined in the PTGA, FDOT will provide grant funding for 5% of the Construction Cost, estimated to be $118,805. BCAD anticipates that the Federal Aviation Administration (“FAA”) will provide grant funding for 90% of the total Construction Cost, estimated to be $2,138,495 and Broward County (“County”) will fund the remaining 5% of the Construction Cost, estimated to be $118,805, and will cover any Project cost overruns.
The proposed Project consists of the construction of a partial parallel Taxiway A west of Runway 1L-19R and reconstruction of the runway crossing at Taxiway N at HWO. The Project includes a new hold pad along Taxiway A north of the Mosquito Control building. The extension will also serve to connect the Ladim hangar development to Taxiway A and Runway 10L. Construction will consist of constructing temporary haul roads from the contractor staging area to the work site, surveying, temporary taxiway connectors, pavement demolition, new asphalt pavement, installing new Light Emitting Diode airfield lighting and guidance signage, sodding, and pavement striping, as well as consultant construction support services such as inspections, materials testing, and administrative support services. These airfield modifications are necessary to comply with current FAA design standards and was identified in the HWO Master Plan Update.
The Office of the County Attorney requested FDOT make certain modifications to a pass-through indemnification provision in the PTGA, but FDOT declined, contending that the indemnification provision is legally sufficient. BCAD desires to move forward with this PTGA to obtain grant funding for the Project. The Office of the County Attorney will work with BCAD to modify the relevant third-party construction or design agreements, as applicable, to comply with the PTGA and mitigate any potential risk associated with the pass-through indemnification provision in the PTGA.
The proposed PTGA has been reviewed by the Office of the County Attorney. The PTGA does not include the County's standard Agreement provisions as FDOT requires the County to use its form agreement.
