Why Action is Necessary
In accordance with the Broward County Procurement Code Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that includes rejection of apparent low bidder.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) contract goal of 5%. BLD Services LLC committed to 5% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).
This contract provides for the rehabilitation, evaluation, cleaning and lining of gravity sewer main line, laterals and maintenance access structures (M.A.S.) throughout Broward County. The work includes video inspection of mains and laterals, cleaning of mains, laterals and M.A.S., chemical grouting, lateral grouting and lining, M.A.S. rehabilitation, M.A.S. to M.A.S. pipe lining, and installation of cleanouts on existing sanitary sewer laterals.
This procurement carries a 50% performance and payment guaranty. The vendor has provided a bid guaranty obligating the vendor to provide requisite performance and payment guaranty, upon notice of award.
The contract includes allowances in the amount of $100,000 for the initial term. Expenditures under the allowance must be approved by the Contract Administrator and will be reimbursed at the vendor’s actual cost without mark-up (Exhibit 1).
The Director of Purchasing has determined the apparent low bidder, Atlantic Pipe Services LLC, to be non-responsible to the bid requirements based on non-compliance with the CBE goal.
Water and Wastewater Services has reviewed the bid submitted by BLD Services LLC and concurs with the recommendation for award (Exhibit 3).
No County vendor performance evaluations have been completed for BLD Services LLC.
The Purchasing Division reviewed the prices submitted by the low responsive, responsible bidder, BLD Services LLC, and has determined that the prices submitted are fair and reasonable based on price analysis (Exhibit 4).
The initial bid submitted by BLD Services LLC was $13,784,200, including an allowance of $100,000. The vendor offered a voluntary price reduction of $195,000, which reduced the total bid amount to $13,589,200. The Broward County Procurement Code, Section 21.41(b), Procedures for ITBs, allows for acceptance of a voluntary reduction in price after bid opening, if such reduction does not result in the modification or deletion of any condition of the solicitation (Exhibit 4).
The bid was advertised on June 25, 2025, and opened on August 14, 2025; four bids were received with no declinations (Exhibit 1).
The Recommendation for Award was posted on the Purchasing Division website. On December 18, 2025, the Director of Purchasing received a timely filed protest from the apparent low bidder, Atlantic Pipe Services LLC. The protest claimed: 1) Atlantic Pipe Services LLC made good faith efforts; 2) The County is estopped from rejecting Atlantic Pipe Services LLC’s documentation (Exhibit 5, without referenced exhibits).
On February 10, 2026, the Director of Purchasing issued a protest response stating: 1) Atlantic Pipe Services LLC failed to meet CBE follow-up requirement; 2) APS misunderstood good faith effort timing. As such, the protest was denied (Exhibit 6).
BLD Services LLC’s bid validity expired on December 12, 2025, and BLD Services LLC has agreed to extend it through April 1, 2026.
The contract consists of the County’s solicitation and the vendor’s response.
The initial contract period begins on the date of award.
