Why Action is Necessary

MOTION A: In accordance with the Broward County Procurement Code, Section 21.25(a), a sole source procurement may be designated when the Director of Purchasing determines that there is only one source or one reasonable source; any nonstandardized sole source procurement above the Director of Purchasing award authority must be approved by the Board.

 

MOTION B: In accordance with Broward County Procurement Code Section 21.19(a), Standardization, the Board is required to approve all standardizations above the award authority of the Director of Purchasing; and Section 21.19(c), the Director of Purchasing may recommend to the Board that any brand or source of goods or services be standardized as the sole brand or sole source of goods or services that will be purchased for a County Agency or countywide.

 

MOTION C: In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The purpose of this action is to designate, standardize, and award only one source, MWI Corporation dba MWI Pumps, as the original equipment manufacturer of MWI Pumps, Parts, and Installation/Removal for the Public Works and Environmental Services Department/Water and Wastewater Services and various other Broward County agencies that may have need of these services and/or products.

 

On February 3, 2026, the Purchasing Division issued a Request for Information (RFI) to ascertain whether there were any other entities able to provide MWI Pumps, Parts, and Installation/Removal at Water and Wastewater Services (WWS). The RFI yielded two responses; however, neither vendor met the authorization requirement. Additionally, the manufacturer, MWI Corporation dba MWI Pumps, indicated that they were the sole representative for the purchase of MWI Pump products (Exhibit 1).

 

The allowances incorporated in the contract, in the total amount of $55,500 per year, are $15,500 for specialized equipment rental and $40,000 for the percentage discount off catalog/list pricing. Expenditures under these allowance items must be approved by the Contract Administrator and will be reimbursed at the contractor’s actual cost without mark-up.

 

WWS has reviewed the quotation submitted by MWI Corporation dba MWI Pumps and concurs with the recommendation for award (Exhibit 3).

 

The initial bid submitted by MWI Corporation dba MWI Pumps was $279,548; the vendor offered a voluntary price reduction of $23,000 which reduced the total initial bid amount to $256,548. The Broward County Procurement Code, Section 21.41 (b), allows for acceptance of a voluntary reduction in price after bid opening, if such reduction does not result in the modification or deletion of any condition of the solicitation.

 

No County vendor performance evaluations have been completed for MWI Corporation dba MWI Pumps.

 

The initial contract period begins on the date of award and terminates one year from that date.

 

The contract consists of the County’s solicitation and the vendor’s response.
