In accordance with Broward County Procurement Code Section 21.47(a), amendments to agreements that exceed the Director of Purchasing’s authority must be approved by the Board of County Commissioners.
What Action Accomplishes
Authorizes additional consultant services for construction administration and post-construction services and updates terms and conditions of the Agreement.

Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) participation goal of 25% for this Agreement. Saltz Michelson Architects, Inc. (“SMA”) has committed to a 57% CBE participation, which has been reviewed and approved by OESBD. To date, SMA has achieved a 54.71% participation rate during the design and bidding and award phases. Saltz Michelson Architects, Inc. has committed to continue utilizing the CBE team members.
On May 19, 2020 (Item No. 29), the Board of County Commissioners approved the Agreement between Broward County and SMA for Consultant Services for Design Services for Tradewinds Park North (the “Agreement”). The Agreement provided $729,992 for Basic Services, $50,000 for Reimbursables, and $48,173 for Optional Services, for a total Agreement amount of $828,165. The Agreement’s scope includes design, permitting, construction contract administration, and warranty administration of a new animal barn, welcome center, open-air event venue, playgrounds, and other site amenities.
On October 1, 2024, the Director of Purchasing approved the First Amendment to the Agreement to increase the Basic Services by $167,575, increase the Optional Services by $47,049, increase the Reimbursables by $900, and reduce the construction contract administration phase by 35 calendar days. The First Amendment expanded the Agreement to include surveying and additional consulting time to complete design tasks extended due to additional requirements from the City of Coconut Creek. The First Amendment also included additional, miscellaneous provisions to cover new federal, state, and local requirements. The First Amendment increased the total Agreement from $828,165 to $1,043,689.
The project is currently awaiting issuance of building permits. The Second Amendment to the Agreement is necessary as it includes additional project record documents required by the City of Coconut Creek, additional consultant services for extended construction administration, including additional site visitations and reports, and warranty phase services to be completed by SMA’s subconsultants. The Second Amendment also includes updates to the County’s standard terms and conditions.
Negotiation meetings for the Second Amendment were held on May 27 and June 17, 2025.These meetings ware attended by representatives of the Parks and Recreation Division, SMA., Delta G Consulting Engineers, EDSA, Inc., Miller, Legg & Associates Inc., and TRC Worldwide Engineering.
If approved, this Second Amendment will increase the Basic Services amount from $897,568 to $1,194,839, increase the Reimbursables amount from $50,900 to $52,520, and maintain the Optional Services amount at $95,222, for a total Agreement increase from $1,043,689 to $1,342,581.
