Summary Explanation/Background

On October 1, 2024, Chapter 2024-266, Laws of Florida (HB 479, Alternative Mobility Funding Systems) will become effective. HB 479 requires that the calculation of impact fees must be based on a study using the most recent and localized data available within four years of the current impact fee update. The County's existing studies for Transportation Concurrency Assessments and impact fees for roads and parks (regional parks and local parks in the Broward Municipal Services District) do not meet the minimum requirements outlined in the statute. Accordingly, the proposed Ordinance amends the Land Development Code to suspend the collection of Transportation Concurrency Assessments and road and recreational impact fees on or after October 1, 2024. The proposed Ordinance also clarifies that neither Transportation Concurrency Assessments nor impact fees paid prior to October 1, 2024, will be refunded unless authorized by the Broward County Code of Ordinances.
