Why Action is Necessary

Applicable law requires the publication of notice and a public hearing for enactment of amendments to the Broward County Code of Ordinances (“Code”).

 

What Action Accomplishes

Enables the setting of a public hearing during which the Board of County Commissioners (“Board”) may consider enacting the proposed Ordinance.

Summary Explanation/Background

Private tag agencies (“PTAs”) are businesses that sell license plates and provide related services to the public on behalf of the Tax Collector. Previously, PTAs operated on behalf of the County in its capacity as tax collector. However, following the recent election of an independent Tax Collector, PTAs no longer operate under the County’s supervision and instead enter into separate agreements with the Tax Collector.

 

The proposed Ordinance, if enacted, would repeal most of the Code provisions relating to PTAs. The Ordinance would retain the consumer protection provisions relating to PTAs but relocate those provisions to the Broward County Consumer Protection Code. Finally, the proposed Ordinance would also update certain general consumer protection provisions, including the removal of obsolete provisions and the reordering and restating of the remaining provisions.
