Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
On April 17, 2007 (Item No. 8), the Board approved the Facility Use Agreement between the County and the Department of Health to coordinate with the Department of Health regarding the use of County-owned facilities for the provision of community public health services, pursuant to Section 154.01, Florida Statutes.
On June 10, 2014 (Item No. 5), the Board approved the First Amendment to the Facility Use Agreement to modify the list of County-owned facilities being utilized by the Department of Health, amend each party’s maintenance and repair obligations, and revise the Notices section of the Facility Use Agreement. On March 1, 2016 (Item No. 4), the Board approved the Second Amendment to the Facility Use Agreement extending the term of the Facility Use Agreement and updating the County’s maintenance obligations. On June 6, 2023 (Item No. 3), the Board approved the Third Amendment to the Facility Use Agreement, which amendment served to remove the North Regional Health Center from the list of County-owned facilities being utilized by the Department of Health under the Facility Use Agreement. On November 14, 2023 (Item No. 14), the Board approved the Fourth Amendment to the Facility Use Agreement to exclude a 920 square foot portion of the South Regional Health Center from the list of County-owned facilities being utilized by the Department of Health under the Facility Use Agreement.
The Department of Health would now like to make improvements to the South Regional Health Center to operate an obstetrics and gynecology (OB/GYN) healthcare clinic at this location. The proposed Fifth Amendment allows for the Department of Heath to construct the OB/GYN healthcare clinic at its sole cost and expense. The proposed Fifth Amendment approves certain improvements as set forth in Exhibit B to the Fifth Amendment, allows the Department of Health to make additional structural improvements with the prior written consent of the County, and allows the Department of Health to make non-structural changes to the facility without the prior approval of the County. All improvements to be made pursuant to the proposed Fifth Amendment is at the sole cost and expense of the Department of Health.
The Fifth Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
