Why Action is Necessary

Board of County Commissioners' approval is required to approve and execute lease agreements and amendments to lease agreements pursuant to Broward County Administrative Code, Section 6.122.

 

What Action Accomplishes

The Agenda Item authorizes execution of the lease modification to increase the size of the leased area and change the configuration of the leased area which will allow the County to install and operate eight mooring slips over the leased area which will be part of a 29 slip public mooring field.

Summary Explanation/Background

THE PARKS AND RECREATION DIVISION AND PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On October 11, 2022 (Item No. 4), the Board approved the Sovereignty Submerged Lands Fee Waived Lease agreement between the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (Lessor) and Broward County (Lessee) for approximately 46,213 square feet of sovereignty submerged land located at Hollywood North Beach Park in Hollywood.

 

The County is developing a mooring field at Hollywood North Beach Park which is known as Loggerhead Park Mooring Field (“Project”). The Project includes a total of 29 public mooring slips adjacent to the Intracoastal Waterway in the coves north and south of Sheridan Street. The Project facilities include floating docks for access to upland park facilities, a vessel sewage pump-out station, an exclusive use general services building with a laundry room, restroom/showers, and manager office, and other general site improvements.

 

Preconstruction benthic surveying encountered a seagrass bed not previously identified in the permitting phase. To avoid impacts, the layout of the mooring fields was adjusted, increasing the size of the leased area from approximately 46,213 square feet to approximately 60,125 square feet and modifying its configuration to exclude the existing seagrass bed area. This proposed lease modification reflects these changes.

 

All documents have been reviewed and approved as to form by the Office of the County Attorney.
