Why Action is Necessary

In accordance with Broward County Administrative Code Section 21.56, change orders exceeding $250,000 must be approved by the Broward County Board of County Commissioners (“Board”) and any change order allowance greater than 10% must be approved by the Board.  Board approval is also required for any transfer from Reserves.

 

What Action Accomplishes

Increases the Change Order allowance for the Wayfinding Information Signage at Port Everglades to accommodate the increase in Change Order No. 5 and any potential additional Change Orders that may be required for the remainder of the construction contract, and provides the additional funding required for the Change Orders.

Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”

 

The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) participation goal of 20% for this Agreement.  Horsepower Electric, Inc. has committed to a 20% CBE participation which has been reviewed and approved by OESBD.  Horsepower Electric has achieved a 20.56% participation rate through February 21, 2024, as verified by OESBD (see Exhibit 2).  Horsepower Electric plans to continue employing CBE firms for the execution of this Change Order.

 

On October 22, 2019 (Item No. 40), the Board approved the Agreement between Broward County and Horsepower Electric, Inc. for the Wayfinding Information Signage at Port Everglades project in the amount of $3,631,302, which included contract allowances for permitting, regulatory agency fees, and identification badges in the amount of $140,000, to be substantially completed by 275 calendar days from the Project Initiation date listed in the Second Notice to Proceed.

 

On August 21, 2021, Change Order No. 1 was approved by the Contract Administrator and included structural and artistic enhancements in the amount of $17,530, increasing the Agreement from $3,631,302 to $3,648,832, and adding 180 days to the period of performance, increasing the contract duration from 275 to 455 days.

 

On January 11, 2022, Change Order No. 2 was approved by the Contract Administrator and included the installation of additional underground raceways and fiber optic cabling in the amount of $45,780, increasing the Agreement from $3,648,832 to $3,694,612, and adding 100 days to the period of performance, increasing the contract duration from 455 to 555 days.

 

On October 11, 2022 (Item No. 8), the Board approved Change Order No. 3, which included additional static and dynamic message signage to further assist Port cruise guests to provide additional guidance concerning various cruise terminal and parking facility locations, adding an amount of $360,890 for that additional work and increasing the Agreement from $3,694,612 to $4,055,502.  Due to substantial lead times associated with supply chain issues, Change Order No. 3 also added 328 days to the period of performance, increasing the contract duration from 555 days to 883 days.  The Board also approved the addition of a change order allowance authority to fund Change Order No. 3, and to provide the Contract Administrator additional change order authority should unforeseen issues be encountered during performance of the additional scope of work that would require additional change orders. 

 

On December 12, 2023, Change Order No. 4 was approved by the Port Everglades Department Director to include one year of service and maintenance for the Dynamic Message Signs in the Port, adding the amount of $108,000 for the additional work, increasing the Agreement from $4,055,502 to $4,163,502, and adding 365 days to the period of performance, increasing the contract duration from 883 to 1,248 days.

 

To provide additional parking for cruise passengers, the Port recently converted a cargo yard in the Midport area of the Port into a surface parking lot.  Upon completion of the lot, it became clear that additional static and dynamic signage would be needed to guide passengers to the new lot.  Additionally, some replacement signs are required to repair signs that were damaged by vehicular accidents.  The proposed Change Order No. 5 for additional signage will add $259,555, increasing the Agreement from $4,163,502 to $4,423,058. No additional contract time is included in the proposed Change Order No. 5.

 

Approval of Motion A also provides additional change order allowance authority for unforeseen issues encountered during the performance of the additional scope covered by Change Order No. 5 that may require additional change orders.
