A. MOTION TO APPROVE Amendment No. 1 to the Public Transportation Grant Agreement (“PTGA”) between the Florida Department of Transportation (“FDOT”) and Broward County for the Design/Construction phase of the Port Everglades Upland Facility Improvements Project (Financial Project No. 452146-1-94-01), increasing the estimated total cost of the Project by $600,000 and increasing FDOT’s maximum participation by $300,000 up to $3,580,000, but not more than 50% of the total eligible project cost, with the County agreeing to pay the remaining 50% and cover any cost overruns, effective upon execution by FDOT; authorize the Mayor and Clerk to execute same; and authorize the County Administrator to take the necessary administrative and budgetary actions to implement the grant.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
The Port Everglades Upland Facility Improvements Project (“Project”) consists of the design and construction of a consolidated maintenance facility on an area currently used for cargo operations, with the goal of centralizing functions that support the Port's core revenue-producing lines of business (i.e., cruise, cargo, and energy). Port Everglades is a ‘landlord port’, by which land and buildings are rented and leased to port and maritime-related businesses and companies. This project will consolidate functional and administrative facilities maintenance operations that are currently located in multiple buildings throughout the Port.
On December 12, 2023 (Item No. 23), the Board approved a Public Transportation Grant Agreement (“PTGA”) between Broward County and FDOT to provide partial funding of the costs associated with the Project of up to $6,560,000 and provided grant funding from FDOT to Broward County in the amount of the lesser of $3,280,000 or 50% of the Project cost. The County was required to provide the greater of $3,280,000 or 50% of the Project cost.
FDOT has approved the disbursement of an additional $300,000 in state funds (total FDOT contribution not to exceed 50% of total eligible cost) under this PTGA Amendment No. 1 for Fiscal Year 2024-2025, which requires matching funds from the County in the amount of $300,000 (50% of total eligible cost), bringing the total Project cost under this PTGA to $7,160,000.
A requirement for this funding is to execute this PTGA Amendment prior to disbursement of any funding. This PTGA Amendment is written in the standard FDOT format. FDOT will execute the PTGA Amendment after Board approval. The PTGA Amendment has been reviewed and approved as to form by the Office of the County Attorney.
