Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.
777 Properties, Inc., a Florida corporation, and 767 Building, LLC, a Florida limited liability Company (together, the “Owners”), are processing development permits for the property parcels immediately east of and adjacent to the Herman and Dorothy Shooster Nature Preserve (“Shooster Preserve”) located in Margate, Florida. As part of this process, the Owners are required to design, permit, and construct the surface water management system for their property. Prior to the County acquiring the Shooster Preserve in 2004, both the Owners’ property parcels and the Shooster Preserve property were under one combined ownership, which was reflected in the original South Florida Water Management District (“SFWMD”) surface water management system permit that was issued on September 12, 1985. The original SFWMD permit provided for a certain limited volume of stormwater to route through the present day Shooster Preserve property and eventually discharge into the City of Margate canal system. The Owners’ proposed development permit will continue to discharge a certain limited volume of pre-treated stormwater into the Shooster Preserve property, but it will now be routed to the on-site wetlands.
Shooster Preserve contains nearly nine acres of wetlands that can benefit from the addition of clean, pre-treated freshwater. County staff worked closely with the Owners to ensure the surface water management system design provides for pre-treatment of the stormwater prior to discharge into the Shooster Preserve property. The proposed easement agreement also includes contingencies to address unforeseen discharge of pollutants onto County property. County staff believes this agreement will benefit all parties by allowing the Owners to permit their current surface water management for their proposed development and by allowing County property to receive high quality, pre-treated water in an appropriate location for the wetland rehydration.
