Summary Explanation/Background

The Broward County Health Facilities Authority (“Authority”) was established pursuant to Chapter 154, Florida Statutes, and Ordinance No. 77-35, enacted by the Broward County Board of County Commissioners (“Board”) for the purpose of issuing conduit bonds to assist health facilities in the acquisition, construction, financing, and refinancing of projects in Broward County.

The Authority has not issued bonds in several years and has no outstanding debt or obligations. Due to such inactivity, on September 18, 2023, the members of the Authority’s governing board voted unanimously to request that the Board dissolve the Authority. Pursuant to Section 15-194 of the Broward County Code of Ordinances (“Code”) and Section 154.207, Florida Statutes, the Board has the power and authority to abolish the Authority by ordinance at any time, provided the Authority has no outstanding bond indebtedness.

The proposed Ordinance (Exhibit 1) abolishes the Authority and repeals Chapter 15, Article XII, Sections 15-173 through 15-194 of the Code pertaining to the Authority.
