Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

US Crane, LLC, while operating on property owned by 2980 W. State Road, LLC, cleared and placed fill within 0.17 acres of an established wetland mitigation area located within Pond Apple Slough Natural Area, which is owned and managed by Broward County. The impacts were discovered on October 28, 2025, during an annual inspection conducted jointly with staff from both South Florida Water Management District (SFWMD) and Broward County Parks and Recreation (BCPRD).

The impacted wetland mitigation area was established pursuant to Environmental Resource Permit No. 06-07122-P, under which Broward County and Florida Department of Transportation (FDOT) are joint permittees. The mitigation was funded and constructed by FDOT and responsibility for the mitigation was transferred to BCPRD in 2022.

SFWMD issued a Notice of Violation (NOV) to Broward County and FDOT concerning noncompliance with Environmental Resource Permit No. 06-07122-P, including impacts to approximately 0.17 acres of wetlands within Pond Apple Slough Natural Area. As part of the proposed resolution of the violation, SFWMD has required restoration of the impacted wetland area and installation of required conservation signage. The proposed License Agreement requires 2980 W. State Road LLC to perform and fund the required restoration work, and provides it with the necessary access to the County-owned property to complete that work. The County is separately resolving the NOV with SFWMD pursuant to the authority delegated by the Board under Section 1-51.3 of the Broward County Code of Ordinances, at no additional cost to the County.
