A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Board”) at its meeting of May 20, 2025.

Summary Explanation/Background

The proposed Ordinance generally repeals certain sections of the Broward County Code of Ordinances (“Code”) that were codified by Broward County following enactment of a Special Act by the Florida Legislature.

 

Performing Arts Center Authority: Sections 1-413 through 1-422 were originally codified in 1984 to restate a 1984 Special Act by the Florida Legislature. The Special Act was subsequently amended and ultimately repealed and replaced by the Florida Legislature in 2005. The proposed Ordinance would refer to the current Special Act and otherwise repeal the remaining provisions; these changes will have no effect on the existence or authority of the Performing Arts Center Authority, which has been informed of and approves of the proposed changes.

 

Municipal elections: Sections 11-21 through 11-28 were codified to restate Special Acts enacted in 1975 and 1976. Those Special Acts have since been superseded by a subsequent Special Act, Laws of Florida 2012-253. The proposed Ordinance would refer to the current Special Act, including as may be amended from time to time, and otherwise repeal the remaining provisions.

 

Schools: Sections 29-1 through 29-76 include a series of obsolete or outdated provisions, primarily regarding the “Board of Public Instruction of Broward County, Florida.” The proposed Ordinance retains a prohibition on sales of goods near schools, but adds an exception to the extent such sales are authorized by The School Board of Broward County (“SBBC”) or an authorized representative. The SBBC has been consulted and approves of the proposed changes.
