Summary Explanation/Background
This item supports the Commission’s “Resilient Community” goal of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection” by facilitating the development of a long-term, environmentally sustainable, transparent, innovative, and economically efficient plan and approach to disposal, reduction, recycling, and reuse of waste generated in Broward County.
On May 23, 2023, the Board approved an interlocal agreement to create, and to join as a member government, the independent legal entity known as the “Solid Waste Disposal
and Recyclable Materials Processing Authority of Broward County, Florida,” (“Authority”). (Exhibit 1.)
Section 5.4 of the interlocal agreement establishing the Authority requires member governments to financially contribute towards the costs of Authority operations during the initial period of the Authority’s existence. The member municipal governments and the County have already made their initial contributions. However, the Authority does not yet have a bank account or the ability to hold and disburse funds.
If this item is approved, the interlocal agreement (Exhibit 2) provides for the County to: (1) hold, on behalf of the Authority, the required financial contributions made by its member governments; and (2) disburse funds (to the extent such funds are available in the account set up by the County on behalf of the Authority) for the payment of the Authority’s expenses as authorized in writing by Chair of the Authority’s Governing Board and/or Executive Committee or the Authority’s Executive Director (when hired by the Authority). The interlocal agreement may be terminated for convenience by either the County or the Authority with 30 calendar days advance written notice to the other party and automatically terminates once the Authority establishes its own bank account and the County disburses any remaining Authority funds to that account.
