A. MOTION TO NOTE FOR THE RECORD County Administrator executed a fourth Modification to Subgrant Agreement Between the Division of Emergency Management and Broward County (“Subgrant Agreement”) to reinstate and extend the terms of the Subgrant Agreement through December 31, 2026, to allow for completion of the retrofitting of the North and Central Homeless Assistance Centers’ (“HAC”) structures and for the installation of emergency generators and to maintain eligibility for grant funding.
B. MOTION TO REAUTHORIZE County Administrator or her written designee to execute any future amendments, change orders, or other documents required by the Division of Emergency Management (“DEM”), or any successor agencies, related to the Subgrant Agreement, provided that such documents do not impose any additional material financial risk or obligation on the County, and are subject to review and approval as to legal sufficiency by the County Attorney’s Office. Why Action is Necessary
MOTION A: Pursuant to the Board’s delegation of authority on May 7, 2019, to execute contracts, amendments, work authorizations, grant applications, grant awards, and other legal documents relating to 2019 hurricane and disaster planning, notice to the Board of any action taken pursuant to the delegation must be placed on the next available agenda after such action.
MOTION B: Absent delegated authority, Board of County Commissioners' approval is required under Broward County Administrative Code, Section 20.31(b)(3), for the execution of all grant agreements and amendments.
What Action Accomplishes
MOTION A: Notifies the Board of action taken to modify the original Subgrant Agreement to reinstate and extend the term of the agreement through December 31, 2026.
MOTION B: Reaffirms and broadens the delegation of authority to the County Administrator to execute any other contract amendments relating to the Subgrant Agreement.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
On December 9, 2019, the Broward County Administrator executed Subgrant Agreement H0383 for project No. 4337-93-R relating to the North and Central HAC for wind mitigation retrofitting and generator installation projects at the facilities located at 1700 Blount Road, Pompano Beach, FL 33069 and 920 Northwest 7 Avenue, Fort Lauderdale, FL 33311, respectively. The wind mitigation and generator improvements portion of the project is partially funded by the Federal Emergency Management Agency’s (“FEMA”) Hazard Mitigation Grant Program (“HMGP”) and is subject to the federal fund’s terms and conditions. The FEMA funded portion amounts to 75% of the HMGP project total and the remaining 25% match is County-funded.

Federal Share: $5,117,322 (75%)
Non-Federal Share (County’s Share): $1,705,774 (25%)
Total Project Costs: $6,823,096
The Subgrant Agreement was extended on March 16, 2022, February 5, 2024, and June 3, 2025. Notice is hereby provided to the Board that the Subgrant Agreement has been reinstated and extended pursuant to the authority delegated on May 7, 2019, via this Fourth Modification to the Subgrant Agreement. The original subgrant agreement had a one year and ten-month term for completion of the work, which did not allow sufficient time for the proper design, procurement, permitting, and construction of the facilities but allows the grant recipient to apply for annual extensions to complete the work. The County Administrator’s execution of the document allows for the expedited execution of the subgrant agreement, permitting the State the proper amount of time to execute it without jeopardizing cost reimbursement to the County. This action maintains funding eligibility, supports timely project completion, and ensures proper closeout without interruption.
