Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”

 

On September 22, 2020 (Item No. 54), the Board approved Lease No. GS-04P-LFL00660 between Broward County and the United States of America, acting by and through the designated representative of the General Services Administration (“GSA”), leasing office space to GSA in Suite 401 of the Port Everglades Administration Building consisting of 2,880 square feet, for a term that commenced on September 14, 2020, for up to 15 years (“Suite 401 Lease Agreement”). The leased space is occupied by the U.S. Department of Commerce Export Assistance Center. On April 6, 2021 (Item No. 13), the Board approved Lease Amendment No. 1 to the Suite 401 Lease Agreement, which approved GSA’s request for Broward County to provide additional routine cleaning and disinfecting services. On December 7, 2021 (Item No. 10), the Board approved Lease Amendment No. 2 to the Suite 401 Lease Agreement, which cancelled the routine cleaning and disinfecting requirements. On April 16, 2024, the Suite 401 Lease Agreement was amended by a unilateral amendment (Lease Amendment No. UWT) that imposed a water quality testing requirement and reimbursement to the County for same.

 

The U.S. Department of Commerce, National Oceanic and Atmospheric Administration (“NOAA”), through the United States of America, acting by and through GSA, has been a tenant in Suite 312 in the Amman Building since 1995. On December 13, 2016 (Item No. 4-PH), the Board approved NOAA’s most recent lease agreement (“Suite 312 Lease Agreement”). On April 16, 2024, the Suite 312 Lease Agreement was amended by a unilateral amendment (Lease Amendment No. UWT) that imposed a water quality testing requirement and reimbursement to the County for same.

 

GSA has now requested that both leases be amended to incorporate Federal Acquisition Regulation Clause 52.222-90, “Addressing DEI Discrimination by Federal Contractors.” The proposed amendment to the Suite 401 Lease Agreement and amendment to the Suite 312 Lease Agreement incorporate this clause and establish related compliance, reporting, recordkeeping, and subcontractor requirements.

 

The Amendments were prepared by GSA using standardized GSA forms and have been reviewed and approved as to form by the Office of the County Attorney. As is customary for GSA leases, Broward County, as lessor, must execute the amendments before execution by the United States Government.
