Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

Hillsboro Boulevard is a County road in the City of Parkland. The City of Parkland desires to improve Broward County right-of-way along Hillsboro Boulevard from west of Juniper Drive to State Road 7.

Motion A seeks Board approval of a Lighting Agreement (“Lighting Agreement”) between Broward County (“County”) and the City of Parkland for the design, installation, operation, and maintenance of a lighting system along both sides of Hillsboro Boulevard from approximately 165 feet west of Juniper Drive eastbound for approximately 0.54 miles to Parkside Drive (Exhibit 1). As a condition of permit issuance for the lighting system installation, a Lighting Agreement was required. However, to enhance safety for the residents of the newly developed adjacent area, the City deemed it necessary to install the lighting system prior to the approval of the agreement. Exhibit 2 is a location map of the installed lighting system.

Motion B seeks Board approval of a Lighting Agreement (“Lighting Agreement”) between Broward County (“County”) and the City of Parkland for the design, installation, operation, and maintenance of a lighting system along both sides of Hillsboro Boulevard from Parkside Drive eastbound for approximately 1.6 miles to State Road 7 (Exhibit 3). Exhibit 4 is a location map of the lighting system. The lighting system will be constructed in conjunction with the County’s West Hillsboro Boulevard Lanes and Lighting Improvements Project. The County roadway project is scheduled to begin construction in the summer of 2025. On behalf of the City, FPL has designed and will construct the lighting system after conclusion of the roadway project, at no cost to the County.

Under the Lighting Agreements, the lighting system will comply with Broward County’s Minimum Standards Applicable to Public Right-of-Way Under Broward County Jurisdiction. The City of Parkland will be responsible for all costs associated with the design, installation, operation, and maintenance of the lighting system, including all electrical energy and other utility charges. The County can terminate the Lighting Agreements with cause. While the Lighting Agreements do not provide for termination for convenience by County, they do provide County with the ability to require the City to remove or relocate the lighting system, at City’s sole cost, for any planned County trafficway improvements that may impact the lighting system. If either Lighting Agreement is terminated, the City of Parkland shall restore the right-of-way to its condition before installation of the lighting or to such condition as approved in writing by the Contract Administrator.

The Lighting Agreements have been reviewed and approved as to form by the Office of the County Attorney.
