Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action allows BCAD to accept additional grant funding from FDOT for the construction of the Project at HWO.
On February 21, 2023 (Item No. 2), the Board approved the PTGA between Broward County (“County”) and FDOT for Financial Project No. 448090-1-94-01 at HWO. The total Project construction cost was estimated to be $2,050,000. FDOT committed to 80% participation of the cost, up to a maximum amount of $1,640,000, and the County was required to fund the remaining 20% estimated to be $410,000, while covering any Project cost overruns.
The proposed Project will install new airfield lighting and guidance signs along Runway 1R-19L and along Taxiway E with new Light Emitting Diode (“LED”) edge lights and signs at HWO. New runway guard lights will also be installed at the intersection of Taxiways E and P at the approach to Runway 1L-19R to inform pilots that they are approaching an active runway. The existing Precision Approach Path Indicators and Runway End Identification Light units will be replaced for each runway with new LED units.
Additionally, the Project will include the demolition and replacement of the existing electrical vault. The new electrical vault will be located southwest of the present Air Traffic Control Tower and will accommodate the increased lighting demands and modernize portions of the equipment and controls. The relocation will also provide additional space for future apron construction to accommodate future tenant demand. Based on the completed Program Definition Document, these required improvements increased the overall project costs. The reconstruction of the Taxiway E intersection and improvements will comply with current Federal Aviation Administration design guidelines.
This action approves the proposed First Amendment to the PTGA to increase the total Project construction cost to $3,675,000, increase FDOT’s share by $1,300,000 to a maximum contribution of $2,940,000, and require the County to increase its match by $325,000, while covering any Project cost overruns.
The Office of the County Attorney requested FDOT make certain modifications to a pass-through indemnification provision in the PTGA, but FDOT declined contending that the indemnification provision is legally sufficient. BCAD desires to move forward with this PTGA to obtain grant funding for the Project. The Office of the County Attorney will work with BCAD to modify the relevant third-party construction or design agreements, as applicable, to comply with the PTGA and mitigate any potential risk associated with the pass-through indemnification provision in the PTGA.
The proposed First Amendment to the PTGA has been reviewed by the Office of the County Attorney. The First Amendment to the PTGA does not include the County's standard agreement provisions as FDOT requires the County to use its form amendment.
