Broward County Commissioners’ approval is required for the execution of the Local Agency Program Agreement and the Joint Participation Agreement.

 

What Action Accomplishes

A. Formalizes the responsibilities of FDOT and Broward County with regard to Project administration and funding of the construction of improvements to enhance traffic operations and safety along Royal Palm Boulevard from east of University Drive to Riverside Drive; and authorizes the Director of Highway Construction and Engineering Division to approve any amendments to the Agreement that do not increase Broward County’s financial obligations, subject to review by the County Attorney’s Office for legal sufficiency.

 

B. Formalizes the responsibilities of Broward County and the City of Coral Springs with regard to project administration and funding of the construction of roadway safety improvements along Royal Palm Boulevard from approximately 500 feet east of University Drive to approximately 2,000 feet west of Riverside Drive; and authorizes the Director of Highway Construction and Engineering Division to approve any amendments to the Agreement that do not increase Broward County’s financial obligations, subject to review by the County Attorney’s Office for legal sufficiency.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

Royal Palm Boulevard, between University Drive and Riverside Drive, is a road under the jurisdiction of the City of Coral Springs (City). The City has been working in collaboration with the Broward Metropolitan Planning Organization (MPO) to implement identified safety improvements along this road segment with federal funding through the Florida Department of Transportation (FDOT). Improvements include new concrete curbs and gutters, sidewalk and ADA curb ramps, pavement striping and signage, and asphalt resurfacing. In the same vicinity, Broward County has a Surtax-project, funded for $2,066,071, to improve the traffic operation of the intersection at Royal Palm Boulevard and Riverside Drive, which is a county road. Planned improvements at the intersection include five-foot bike lanes, crosswalks with detectable warnings, dual left turn lanes in the southbound direction of Riverside Drive, a dedicated right-turn lane and dual left-turn lanes in the westbound direction of Royal Palm Boulevard.  The project will be implemented with no change in the number of vehicle travel lanes.

 

During coordination meetings among Broward County, City, MPO, and FDOT, all parties recognized the benefits of implementing these two projects together to improve efficiency, reduce cost and minimize public impact. FDOT agreed to design both projects together at its cost and to provide majority funding for their construction. Design has been completed and FDOT has requested that Broward County manage the construction for both projects. County staff have reviewed and accepted the design.

 

FDOT proposes to enter into a Local Agency Program (LAP) Agreement with the County under which FDOT will commit construction funding for the two projects. The estimated capital cost for both projects is $2,492,178, with estimated construction costs of $890,616 for the City’s safety improvements, $1,375,000 for the County’s intersection improvements and $226,562 for combined construction engineering and inspection costs. FDOT will provide federal funding reimbursement in the amount of $1,825,000, which will cover the City’s project cost and majority of the County’s project cost. The County will only be responsible for the Project’s remaining balance of $667,178. This will result in a significant reduction from the County’s originally budgeted amount of $2,066,071 for the intersection improvements. Unused funds will be reallocated back to the Surtax to fund other County projects. Similarly, City and County have proposed to enter into a Joint Participation Agreement to combine the City’s safety improvement and County’s intersection improvement under one project to be managed by the County.

 

Motion A seeks Commission approval of a Local Agency Program Agreement to provide funding from FDOT for construction of improvements to enhance traffic operations and safety along Royal Palm Boulevard from east of University Drive to Riverside Drive (Exhibit 1). Under this Agreement, FDOT agrees to provide funding up to the maximum amount of $1,825,000 for construction costs. Broward County agrees to bear all expenses in excess of FDOT’s participation. This item also seeks Commission approval to authorize Director of Highway Construction and Engineering Division to approve any amendments to this Agreement that do not increase Broward County’s financial obligations, subject to review by the County Attorney’s Office for legal sufficiency.

 

Motion B seeks Commission approval of a Joint Participation Agreement to construct safety improvements along Royal Palm Boulevard from 500 feet east of University Drive to 2,000 feet west of Riverside Drive (Exhibit 2) as part of the overall Project with FDOT. Under this Agreement, the City of Coral Springs will fund all construction cost overruns, up to $158,558 related to the City project. This item removes any financial responsibility from the County for all work constructed along this segment of the City road and covers any City costs that will not be funded under the FDOT Local Agency Program Agreement. This item also seeks Commission approval to authorize Director of Highway Construction and Engineering Division to approve any amendments to this Agreement that do not increase Broward County’s financial obligations, subject to review by the County Attorney’s Office for legal sufficiency.
