Summary Explanation/Background
TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This item supports the Board's Connected Community Goal of " Cooperatively Delivering an Efficient and Accessible Regional Intermodal Transportation Network" and its Accountable Government Goal of “Consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work and visit.”
A public hearing will allow public comments on the Broward County 2026-2029 Triennial Title VI Program Plan.
Pursuant to 49 U.S.C. § 5307(b) and (c)(1), BCT must provide an opportunity for public participation, including a public hearing, before adopting changes to its Triennial Title VI Program. Consistent with BCT's Title VI Program, public participation is conducted using neutral, locally developed criteria - including the routes and riders a proposal affects, service-area geography, ridership, documented language need, disability access, digital-access barriers, and meeting accessibility - and remains open to all interested members of the public. Public participation must include outreach, an opportunity for public comment, and a public hearing. Consistent with BCT's Language Assistance Plan and 28 CFR § 42.405(d), BCT provides interpretation and translation support to ensure meaningful access for individuals with limited English proficiency, and ensures public hearings are held in ADA-accessible facilities with accommodations available upon request.
In accordance with Title VI of the Civil Rights Act of 1964, FTA Circular 4702.1B, “Title VI and Title VI-Dependent Guidelines for Federal Transit Administration Recipients,” dated October 1, 2012, transit providers are required to submit Title VI program updates on a Triennial basis to the FTA. The proposed Broward County 2026-2029 Triennial Title VI Program update document is posted on BCT’s website for public comment at https://www.broward.org/bct/TitleVI#accordion-documents-and-forms <https://www.broward.org/bct/TitleVI>.
The primary objectives of BCT's Title VI Program are to ensure, without regard to race, color, or national origin, that recipients of federal financial assistance provide services for all persons that meet the following requirements: 1) transit programs and services are administered under neutral operational criteria - applied to service, fare, vehicle, amenity, facility, and outreach decisions - without preferences, quotas, demographic balancing, or differential service allocation based on protected traits; 2) BCT's Title VI duties are implemented consistent with its current FTA award obligations and applicable nondiscrimination statutes and regulations, to the extent those obligations are consistent with controlling law; 3) demographic information is maintained only as necessary for federal reporting, reasonable language access, and evidence relevant to review of intentional discrimination, and is not used to establish service-allocation targets; 4) BCT does not classify, select, or provide preferential treatment to any person on the basis of race, color, or national origin; and 5) corrective action is taken to address instances of intentional discriminatory treatment, consistent with 49 CFR § 21.5 as amended by the Department of Transportation's June 11, 2026 final rule (91 Fed. Reg. 35424).
No fiscal impact will occur resulting from this action. However, if Broward County does not comply with mandated requirements, it may be deemed deficient, and any pending federal grants cannot be approved by the FTA until the deficiency is corrected.
