In accordance with Broward County Procurement Code Section 21.47.a, action by the Broward County Board of Commissioners is necessary to amend contracts.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the County Commission’s goal of Resilient Community, “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure and environmental protection.”

 

Support for this item (Exhibit 1) provides for additional coastal engineering services to aid construction administration and monitoring of Sand Bypass project implementation located at Port Everglades.  Section 3.3 of the original agreement, approved on January 8, 2002 (Agenda Item No. 18), provides that the County and Consultant may negotiate additional scopes of services, compensation, time of performance and other related matters for future phases of the Project.

 

The Office of Economic and Small Business Development has set a County Business Enterprise (CBE) participation goal of 20% of total services, as stated in Section 8.5 of the Agreement and updated with Amendment 8.

 

This Ninth Amendment provides for pre-, during, and post-construction services (including administration, physical, and biological monitoring) required for the construction of the Sand Bypass Project in addition to optional services which may include construction administration and monitoring for the first bypassing event, and additional monitoring tasks. Authorizations for these tasks are withheld until required.

 

This Ninth Amendment includes a maximum increase in contract amount not to exceed $5,695,091 for approved tasks and an additional $4,303,641 in withheld tasks, for a total amended contract amount of $9,975,812, bringing the full contract amount to $15,219,171.

 

Details of the agreement history and individual tasks are provided in Exhibit 2.

 

The Sand Bypass project at Port Everglades has been a priority project of interest for decades to address chronic shoreline erosion south of the Port Everglades Inlet. The Port Everglades Inlet, and the associated Federal navigation project, are recognized to create a complete barrier to littoral drift of sand from north to south, impacting the southern Broward County shoreline.  Most sand naturally transported from north of the inlet is either: 1) impounded and deposited north of the inlet; 2) deposited in the inlet channel; and/or 3) transported offshore and lost from the system.  The effect is sand depletion and chronic shoreline erosion south of the inlet (i.e., the Segment III shoreline).

 

The need for artificial sand bypassing at Port Everglades Inlet has been evaluated by numerous investigations completed by both the Corps of Engineers and Broward County for a period greater than fifty years.  These investigations have consistently recognized the barrier that that Port Everglades Inlet presents to littoral drift along the southern Broward County shorelines and identified artificial sand bypassing as the only method of physically transferring sand across the inlet.

 

The Port Everglades Sand Bypass Project proposes to create and modify inlet infrastructure on the north side of the inlet to provide sand collection and storage facilities sufficient to support the economical collection and transfer of beach compatible sand to the shoreline south of the inlet.  The project includes construction of a sand trap on the north side of the inlet and the periodic transfer of sand across the inlet every two to four years.  A portion of the rubble spoil shoal located about 800 feet north of the inlet will be removed to reduce sand accumulation along the north shoreline and make sand available in the sand trap for transfer to the beaches south of the inlet.  All bypassed sand will be placed within the alongshore and cross-shore limits of the Broward County Shore Protection Segment III fill template.  It is anticipated that the sand quantity to be bypassed across the inlet may vary from 100,000 to 225,000 cubic yards per event, satisfy approximately 50% of the Segment III sand needs and thereby reducing the scale and frequency of future Segment III nourishment projects.

 

Implementation of sand bypassing at Port Everglades is a crucial part of the County’s long-term regional beach management goals and considered the most sustainable approach by keeping and making optimal use of sand that is already in the system and reducing the size of future projects which currently rely upon track haul of sand sourced from mines in the central part of the state. The County has received the Joint Coastal Permit for the Port Everglades Sand Bypass Project from the State Department of Environmental Protection and United States Army Corps of Engineers. Construction of the sand trap is currently estimated to commence in the fall of 2024 or spring of 2025 and will require four project elements: dredging, jetty improvements, rubble removal, and mitigation. The dredge portion of the project was successfully bid and is presented separately for board approval.

 

The Sand Bypass Project is eligible for 75% cost share by the State, with staff to apply for project reimbursement via the State’s annual Local Government Funding Request (LGFR) process.

Costs for services incurred by the County and delivered under this Ninth Amendment are subject to partial reimbursement by the State of Florida.
