Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND THE URBAN PLANNING DIVISION RECOMMEND APPROVAL.
A request has been filed to amend the Regional Road Concurrency Agreement Construction of Improvements in connection with the Millcreek Ranches (050-MP-02), Diamond Creek (052-MP-02) and Blackstone Creek (053-MP-02) Plats recorded in the Official Records Book 37895, Page 922 of the Official Records of Broward County (Exhibit 2), related to the development requirements to satisfy concurrency requirements for impact areas. The Applicant is requesting release from the portion of the agreement related to the Millcreek Ranches and Diamond Creek Plats and is requesting to amend that portion of the agreement related to the Blackstone Creek Plat. The Millcreek Ranches and Diamond Creek plats now satisfy concurrency requirements.
On January 26, 2022, the Broward County Urban Planning Division issued a Notification of Failure to Satisfy Broward County Concurrency Standards for the regional transportation network, finding that the application for approval of or amendment to the portion of the Blackstone Creek plat does not satisfy the impact area concurrency standards for the regional road network as stated in the Broward County Land Development Code. The Applicant has since conducted a traffic study and has determined that certain remedial measures will mitigate the traffic impacts so that the plats or amendment to the plats will satisfy Broward County concurrency standards. The amended agreement reflects the remedial measures (Exhibit 3).
Staff recommends approval of the applicant’s request, and the agreement has been approved as to form by the Office of the County Attorney.
