Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION AND HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

Cypress Creek Road (NW 62nd Street) from Powerline Road (NW 9th Avenue) to the South Florida Rail Corridor is an eight-lane County Road within the City of Fort Lauderdale. In a collaborative effort among Broward County, the Broward Metropolitan Planning Organization, the Florida Department of Transportation, and the City of Fort Lauderdale, this road segment will be reconstructed under a project to enhance bicycle and pedestrian safety.

 

To meet the project’s funding requirements, all portions of the road being reconstructed must be within the right-of-way and vested to the County. However, within the project limits along the south side of Cypress Creek Road east of the intersection with Powerline Road, there is an irregularly shaped portion of the road, including sidewalk, curbing, gutter, and other road appurtenances, measuring approximately 390 feet by 12 feet, that lies outside the road right-of-way.

 

Florida Statutes, Section 95.361(1) provides for roads to be presumed dedicated to the County, if the road has been constructed and maintained continuously and uninterruptedly for four years by Broward County along with the filing of a map in the Office of the Clerk of Circuit Court of Broward County. The portion of Cypress Creek Road identified in the Maintenance Map (Exhibit 3) was constructed and has been maintained for approximately 28 years by Broward County.

 

Approval of this motion will authorize the filing of a certified Maintenance Map in the Office of the Clerk of Circuit Court of Broward County, providing evidence of County’s ownership of the portion currently lying outside the right-of-way.

 

The Resolution and Maintenance Map have been reviewed and approved as to form by the Office of the County Attorney.
