Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The proposed Resolution (Exhibit 1) approves acceptance of a Sovereignty Submerged Lands Easement (“Easement”) from the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (“TIITF”), commencing on May 10, 2021, on a portion of real property located at the northeast intersection of the Stranahan River and the Atlantic Ocean in the City of Fort Lauderdale (see Exhibit 3, Location Map). The Easement (Exhibit 2) is required for the construction and maintenance of a sediment impoundment basin.
On February 3, 2017, the Florida Department of Environmental Protection (“FDEP”) issued Broward County a Consolidated Joint Coastal Permit and Intent to Grant Sovereign Submerged Lands Authorization (Permit No. 0289308-004-JC) (Exhibit 4), authorizing Broward County to construct and maintain a sediment impoundment basin and related improvements (“Project”). The Easement provides Broward County with the necessary property interest to construct and maintain the Project within the permitted area. TIITF has delegated authority to FDEP to review and approve the issuance of sovereignty submerged lands easements.
The Easement has a ten-year term commencing May 10, 2021. The retroactive effective date reflects the State’s authorization timeline associated with the Project.
The Resolution and Sovereignty Submerged Lands Easement have been reviewed and approved as to form and legal sufficiency by the Office of the County Attorney.
