Why Action is Necessary
A. In accordance with Broward County Procurement Code, Section 21.56, Change Orders - Construction Contracts, Broward County Board of County Commissioners (“Commission”) approval is required for a change order allowance of more than 5%.
B. In accordance with Broward County Procurement Code, Section 21.56, Change Orders - Construction Contracts, Commission approval is required for change orders of $250,000 or more.
What Action Accomplishes
A. Provides for an increase to the change order allowance to 10% of the contract amount.
B. Provides funding for the additional scope of Reconciliation Change Order for Estimated Unilateral Change Order No.3.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND WATER AND WASTEWATER SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development established a County Business Enterprise (“CBE”) participation goal for the Contract between Broward County and Lanzo Construction Co., Florida (“Lanzo”), Contract No. PNC2121645C1, for Utility Analysis Zone 113A (“Contract”) of 35%. As of November 20, 2025, Lanzo has been paid $11,813,933 with $4,613,518 paid to CBE firms, yielding 39.05% CBE participation (Exhibit 1).
On February 9, 2021, the Director of Purchasing approved the Contract in the amount of $12,875,438, which included a 5% ($643,772) change order allowance and a contract duration of 540 calendar days (Exhibit 2).
To date, four change orders have been approved, in total amount of $486,843, increasing the Contract amount to $13,362,281 and revising the Contract time from 540 calendar days to 697 calendar days.
During construction, unforeseen conditions were encountered associated with the sewer installation located at Northwest 35 Terrace, north of Northwest 26 Street in the City of Lauderdale Lakes. Specifically, Lanzo’s pipe-bursting operation failed due to unforeseen concrete encasement that was encountered surrounding the existing sewer main beneath the drainage canal. This failure required extensive additional out-of-scope work to replace the main and restore sewer service. The additional work included temporary bypass pumping, isolating and dewatering the canal, excavating under the canal, and restoring the canal to its original cross-section and profile.
On September 12, 2022, Estimated Unilateral Change Order No. 3 was approved in the amount of $127,546 because County staff, Consultant, and Lanzo were unable to agree upon the cost. Estimated Unilateral Change Order No. 3 required Lanzo to perform the work with the understanding that, if necessary, final costs would be reconciled based on actual costs when the work was completed.
If authorized, Motion A provides for an increase to the change order allowance for the Contract. The additional change order allowance will allow for the approval of the Reconciliation Change Order for Estimated Unilateral Change Order No. 3 as included in Motion B.
If approved, Motion B enables the Reconciliation Change Order for Estimated Unilateral Change Order No. 3 to proceed, reconciling the difference between the approved estimated unilateral change order and the actual cost Lanzo incurred in completing the work in the amount of $471,230 (Exhibit 3).
