Applicable law requires the publication of notice and a public hearing for enactment of amendments to the Broward County Code of Ordinances (“Code”).

 

What Action Accomplishes

Enables the setting of a public hearing during which the Board of County Commissioners (“Commission”) may consider enacting the proposed Ordinance.

Summary Explanation/Background

Section 31½-75 of the Broward County Code of Ordinances establishes the Transportation Surtax Oversight Board (“Oversight Board”), identifies the membership of the Transportation Surtax Oversight Board Appointing Authority (“Appointing Authority”), and establishes requirements and procedures relating to the administration and oversight of Transportation Surtax proceeds.

 

The proposed Ordinance updates Oversight Board membership and qualifications and Appointing Authority membership, conforms municipal project funding procedures to the then-applicable Transportation System Surtax Interlocal Agreement, clarifies the Oversight Board’s review and advisory role for proposed projects and expenditures while preserving the Commission’s authority to determine which projects and expenditures are approved, and updates project oversight and audit requirements.

 

If this item is approved, the County Administrator will be directed to publish a Notice of Public Hearing relating to the Commission’s consideration of the proposed Ordinance.
