Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) approval is required for agreements, or delegation of authority to enter into agreements, with external agencies.

 

B.                      A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Broward County Board of County Commissioners (“Commission”).

 

What Action Accomplishes

Approval of Motion A would enable the provision of required matching funds to the Low-Income Pool (“LIP”) program for uninsured residents who receive behavioral health services from Henderson Behavioral Health.

 

Approval of Motion B waives a conflict arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” Approval allows Broward County to provide matching funds for the LIP program.

 

Commission approval allows Broward County to meet a portion of the local match requirements for the Low-Income Pool (“LIP”) program and will allow Henderson Behavioral Health to draw down approximately $5 million to provide behavioral health services to uninsured clients. The required Letter of Agreement with AHCA, which will be in the state’s format, must be signed by October 15, 2024, will be reviewed by the Office of the County Attorney for legal sufficiency prior to execution by the County Administrator.

 

On March 11, 2024, the Human Services Department published its FY2025 General Funds Request for Proposals (“RFP”). Services were advertised for the Children’s Services Administration Section, the Health Care Services Section, the Housing Options, Solutions and Supports Division, and the Broward Addiction Recovery Division (Exhibit 1).

On July 19, 2024, the Children’s Services Board (“CSB”) reviewed and approved the funding recommendations for the Children’s Services Administration Section and submitted a letter of support that was attached to the agenda report dated September 5, 2024, as further described below.

 

On September 5, 2024, the Board of County Commissioners approved the Agenda Item No. 7 File No.: 21-1010. This agenda included the funding recommendations from the RFP and supported by the CSB.

 

On September 23, 2024, County Administration received an email from Henderson requesting County funding be used to leverage the LIP program funding from AHCA in the amount of $1,740,149. The email included attached documentation from AHCA indicating the current funding for Henderson would come from the Children’s Services Council.

 

On October 2, 2024, Henderson submitted an email to CPD indicating the County funding that they proposed would be used as match to leverage LIP funding (Exhibit 2). Though the amount requested by Henderson is $1,740,149, the County match is actually $1,344,891, as this is the maximum amount of funding requested of the County by AHCA.

Upon approval of this item by the Board, and subsequent approval of the Letter of Agreement with AHCA by the County Administrator through her delegated authority, the Human Services Department will enter into an agreement with Henderson Behavioral Health that will articulate the expectations for service provision consistent with the results of the RFP process described above using a portion of the $5M in LIP money they are expected to receive from AHCA.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached to this report as Exhibit 3 and constitutes full disclosure of any existing conflicts.

 

This item is submitted as a late supplemental item as the County was only notified of the needed match amount by AHCA on Thursday, October 3, 2024, with a deadline for approval of October 15, 2024, which is before the next scheduled board meeting.
