MOTION TO APPROVE Contract No. GC190 (“Contract”) between the Florida Department of Environmental Protection (“FDEP”) and Broward County for an estimated $6,000,000 in revenue to Broward County, providing for the continued management of petroleum contamination cleanups within Broward County; authorizing the Contract Manager to approve and execute Task Assignments throughout the term of the Contract, subject to review and approval for legal sufficiency by the County Attorney’s Office; and authorizing the County Administrator to take any necessary administrative and budgetary actions to implement the contract.

Why Action is Necessary
Commission action is necessary to approve the proposed Contract and provide the delegated authority and to recognize it within the Petroleum Cleanup Fund of the Public Works and Environmental Services Department.
What Action Accomplishes
This action will replace Contract No. GC890 with Contract No. GC190, which provides for the appropriation and expenditure of annually allotted State funds to compensate Broward County for the oversight of petroleum contamination cleanups.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Commission’s goal of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”
Approval of this item approves the contract between the FDEP and the County, permitting the County to continue management of petroleum contamination cleanups within Broward County on behalf of the State. Work under the contract is assigned via annual Task Assignments. The contract also authorizes the FDEP to use performance incentives in their Task Assignments.
The Commission previously approved Contract No. GC890 between the County and FDEP on September 20, 2016 (Item No. 10), for oversight of the cleanup of petroleum contaminated sites within Broward County and authorized the agreement manager to execute annual Task Assignments.
Contract No. GC890 expires June 30, 2026; accordingly, it is now necessary to approve the replacement Contract No. GC190 (Exhibit 1), effective July 1, 2026, through June 30, 2031. Contract No. GC190 has been reviewed by Risk Management.
Contract No. GC190 does not include the County’s standard agreement provisions, as the County is the recipient of contract funds and FDEP requires the County to use FDEP’s form agreement.

There is no cost to the County; revenue is provided by this Contract to Broward County to pay for all Contract-related costs. Under the Contract, revenue is allotted annually under each Task Assignment and received in monthly payments. The total value of the Contract Amendment is estimated to be $6,000,000.
