MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on November 10, 2026, at 10:00 a.m., in Room 422 of Governmental Center East to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO ZONING; AMENDING SECTION 39-4 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”) TO REVISE THE DEFINITION OF CERTIFICATE OF USE; AMENDING SECTION 39-19 OF THE CODE TO PROVIDE CERTIFICATE OF USE REQUIREMENTS FOR HOLIDAY WAYSIDE STANDS; AMENDING SECTION 39-85 OF THE CODE TO PROVIDE REQUIREMENTS FOR THE INSTALLATION AND PERMITTING OF SYNTHETIC TURF; REPEALING SECTION 39-239 OF THE CODE RELATING TO HOLIDAY WAYSIDE STAND PERMITS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
The proposed Ordinance simplifies the County’s approval process for temporary holiday wayside stands. The existing provisions of Section 39-239 of the Code require a separate holiday wayside stand permit and include outdated requirements that have made it difficult for members of the public to obtain the necessary approval. The proposed Ordinance repeals Section 39-239 and instead requires operators of holiday wayside stands to obtain a Certificate of Use under Section 39-19 of the Code. This change eliminates the outdated permit requirements while retaining appropriate standards relating to the location and operation of holiday wayside stands.
Chapter No. 2025-140, Laws of Florida, prohibits local governments from regulating synthetic turf on single-family residential properties that are one acre or less in size in a manner inconsistent with standards adopted by the Florida Department of Environmental Protection (“FDEP”). The FDEP standards are set forth in Rule 62-308.100, Florida Administrative Code, as amended. Consistent with State law, the proposed Ordinance incorporates the applicable FDEP standards into the Code and establishes a permitting process to verify that synthetic turf and its installation comply with those standards. The proposed Ordinance does not establish additional substantive standards for synthetic turf.
