Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/ REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Broward County (“County”) is the holder of an Easement (recorded in Official Records Book 10548, Page 312) on certain real property owned by Coral Springs Holding, LLC (“Owner”) located at 9201 West Sample Road, Coral Springs, Florida 33065 (“Property”). The purpose of the County’s Easement is for the establishment of bus bays utilized by Broward County Transit. Owner desires to donate a portion of the Property to FDOT which will allow FDOT to make future roadway enhancements on portions of the Property encumbered by the County’s Easement. The County’s Easement will remain until such time a new bus shelter easement is incorporated and in use on the Property. FDOT requires that all entities with an interest in the proposed FDOT property execute a Subordination Agreement subordinating their interests to FDOT. The Subordination Agreement has been reviewed by Broward County Transportation Department, Traffic Engineering and Highway Construction and Engineering Divisions and there are no objections to subordinating the County’s interests.
