Why Action is Necessary
Board action to accept a conservation easement is authorized by Sections 125.01(3) and 704.06(3), Florida Statutes, and necessary to fulfill the requirements of Environmental Resource License (“ERL”) No. DF03-1252, issued pursuant to Chapter 27 of the Broward County Code of Ordinances.
What Action Accomplishes
The action provides for the perpetual maintenance and conservation of the mitigation site by the grantor.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This item supports the Board’s goal of ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.
On April 9, 2004, the Public Works and Environmental Services Department (“PWESD”) issued ERL No. DF03-1252 (see pages 11 through 19 of Exhibit 1) to Jeffery Evans for the development known as Hidden Hollow Townhomes. ERL No. DF03-1252 required a 0.31-acre multi-habitat wetland mitigation area with native wetland vegetation to establish a viable wetland. ERL No. DF03-1252 also required the licensee to convey a Deed of Conservation Easement to the County over the area as shown in page ten of Exhibit 1 to ensure the area will remain in perpetuity and be maintained by the grantor.
The Deed of Conservation Easement was reviewed and approved as to form by the Office of the County Attorney.
