Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.
Hillsboro Boulevard is a County road in the City of Parkland. The City of Parkland desires to improve Broward County right-of-way along Hillsboro Boulevard from Parkland Bay Trail to University Drive.
Motion A seeks Board approval of a Lighting Agreement (“Lighting Agreement”) between Broward County (“County”) and the City of Parkland for design, installation, operation, and maintenance of a lighting system along the north side of Hillsboro Boulevard from Parkland Bay Trail eastbound for approximately 1.2 miles continuing along the north and south sides of the road to University Drive (Exhibit 1). Exhibit 2 is a location map of the lighting system. The proposed lighting system will comply with Broward County’s Minimum Standards Applicable to Public Right-of-Way Under Broward County Jurisdiction. Additionally, The City of Parkland will be responsible for all costs associated with the design, installation, operation, and maintenance of the lighting system, including all electrical energy and other utility charges. The County can terminate this Agreement with cause. While the agreement does not provide for termination for convenience by County, it does provide County with the ability to require the City to remove or relocate the lighting system, at City’s sole cost, for any planned County trafficway improvements that may impact the lighting system. If this Agreement is terminated, the City of Parkland shall restore the right-of-way to its condition before installation of the lighting or to such condition as approved in writing by the Contract Administrator.
Motion B seeks Board approval of a Beautification Agreement (“Beautification Agreement”) between Broward County (“County”) and the City of Parkland for design, installation, and maintenance of landscape improvements along the south side of Hillsboro Boulevard from Parkland Bay Trail to approximately 860 feet west of Nob Hill Road (Exhibit 3). Exhibit 4 is a location map of the landscape improvements. The landscape improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. The City of Parkland will be responsible for all costs associated with the design, installation, and maintenance of the landscape improvements. The County can terminate this Agreement with or without cause. If this Agreement is terminated, the City of Parkland must remove all landscape improvements and restore the Right-of-way to its condition before the installation of the landscape improvements or to such condition as approved in writing by the Contract Administrator.
Both the Lighting and Beautification Agreements have been reviewed and approved as to form by the Office of the County Attorney.
