Why Action is Necessary
Pursuant to Section 21.53(a) of the Procurement Code, unless otherwise provided by law or excepted therein, a County contract shall not exceed five (5) years in duration, inclusive of any renewals or extensions provided for in the contract, without the express approval of the Board.
What Action Accomplishes
Allows for the reinstatement and extension of the term of the Agreement to allow for continued Building Automation and Technical Support at various County facilities.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Broward County (“County”) and Siemens Industry, Inc. (“Siemens”) entered into an Agreement for Siemens Building Automation and Technical Support (BLD2123048A1 f/k/a BLD2122400A1) (the “Agreement”), for certain building automation systems preventative maintenance, building automation systems repair and replacement, and remote building automation system support with a five-year term commencing on January 31, 2021, and continuing through January 31, 2026, for a total not-to-exceed amount of $3,893,716. On March 14, 2024, the County and Siemens executed the First Amendment to the Agreement, which added security requirements and clarified the Contract Administrator’s authority to approve optional services that do not exceed $7,500.
On June 2, 2020, under Agenda Item No. 31, the Board approved Siemens as a standardized Sole Source provider for Siemens Building Automation and Technical Support. Pursuant to Section 21.19 of the Broward County Procurement Code, following such Board approval, the Director of Purchasing was authorized to execute the Agreement without further Board approval, regardless of the contract amount. Most recently, on March 7, 2024, under Agenda Item No. 28, the Board reaffirmed Siemens as a standardized Sole Source provider for Siemens Building Automation and Technical Support. Although Siemens Building Automation and Technical Support remains standardized under Section 21.19 of the Procurement Code, Board approval of this Second Amendment is required pursuant to Section 21.53(a) of the Procurement Code because the Second Amendment extends the duration of the Agreement beyond five (5) years.
The Second Amendment reinstates and retroactively extends the Agreement for an additional forty-two (42) months, with the option to further extend the Agreement for up to two (2) optional one-year renewal periods through July 31, 2031, and increases the not-to-exceed amount by $5,616,293, for a total not-to-exceed amount of $9,510,009 through July 31, 2031. The Second Amendment is retroactively effective as of February 1, 2026.
