Summary Explanation/Background
THE PURCHASING DIVISION AND THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT/HUMAN RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This procurement was solicited to engage the services of a qualified firm to provide Third Party Administration of Employee Health Savings, Health Reimbursement, and Flexible Spending Accounts. Services include, but are not limited to, implementation, enrollment processing, standard reporting, participant statements, claims and reimbursement processing, investment options for Health Savings Accounts, web services, non-discrimination testing, debit/credit cards, and administration of claims runout and account reconciliation.
On August 7, 2023, Request for Proposals (RFP) No. GEN2126551P1, Third Party Administration of HSA, HRA, and FSA, was advertised. At the time of the September 1, 2023 submittal deadline, seven firms submitted proposals.
On December 8, 2023, an Initial Evaluation Committee (EC) meeting was held. The EC evaluated the submittals and determined that five of the seven firms were responsive and responsible to the RFP requirements and would proceed to final evaluation.
On February 7, 2024, a Final EC meeting was held. After presentations, evaluation, scoring, and ranking, the EC named Total Administrative Services Corporation (Score: 197) as the first-ranked firm; HSA Bank (Score: 185) as the second-ranked firm; PayFlex Systems USA, Inc. (Score: 177) as the third-ranked firm; Eagles, Benefits by Design, Inc. (Score: 175) as the fourth-ranked firm; and WEX Health, Inc. (Score: 132) as the fifth-ranked firm (Exhibit 1).
The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from February 21 - 26, 2024, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers.
On February 22, 2024, the Director of Purchasing received an objection to the proposed recommendation of ranking from PayFlex Systems USA, Inc. (PayFlex). PayFlex’s objection contained two assertions stating that: 1) they provided responses that included the missing sections of the Evaluation Criteria, and 2) their information was not present during the initial evaluation, which could have significantly impacted the committee's rating (Exhibit 2).
On March 15, 2024, the Director of Purchasing issued a response to PayFlex’s objection assertions stating that, after review of the procurement records and proceedings of the EC, and in consultation with the Office of the County Attorney, the issues raised in the objection were not of sufficient merit to recall or otherwise alter the recommendation of the EC. The evaluation of firms was conducted appropriately and within established requirements, guidelines, practices, and procedures set forth in the Broward County Procurement Code, County Ordinances, and existing written guidelines of the Purchasing Division. As such, the objection was denied (Exhibit 3).
The EC’s final recommendation of ranking was posted on the Purchasing Division website from March 18 - 22, 2024, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.
