A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO WASTE COLLECTION SERVICES; REPEALING SECTION 38.39 AND EXHIBIT 38.A OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”); CREATING A NEW SECTION 38.39 OF THE ADMINISTRATIVE CODE RELATING TO WASTE COLLECTION SERVICES FOR UNINCORPORATED AREAS WITHIN BROWARD COUNTY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
The Board of County Commissioners (“Board”) directed the Office of the County Attorney to draft modifications to various provisions in Chapter 14 of the Broward County Code of Ordinances (“Code”) relating to the collection of garbage in the unincorporated areas of the County and also to the issuance of licenses to trash haulers to collect garbage within the “Open Market Area” that is itself within the unincorporated portions of the County.
In conjunction with the proposed Ordinance amending these sections of the Code, the Solid Waste and Recycling Services Division and the Office of the County Attorney recommend that Section 38.39 of the Broward County Administrative Code (“Administrative Code”), which addresses the same subject matter, be modified.
Section 38.39 of the Administrative Code defines the geographic boundaries of various trash collection “service areas” within the unincorporated portions of the County, provides for franchise agreements with trash haulers for the collection of garbage in these areas, and establishes fees to be paid to the County in connection with those franchise agreements.
If the Board adopts the proposed Resolution, Section 38.39 of the Administrative Code, along with Exhibit 38.A of the Administrative Code, will both be repealed and a new Section 38.39 will be adopted, conforming that section with the proposed Ordinance also being considered by the Board on the same agenda as this item.
