A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO TOWING AND IMMOBILIZATION SERVICES; AMENDING SECTION 40.50 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Action by the Broward County Board of County Commissioners (“Board”) is necessary to adopt a Resolution Amending the Broward County Administrative Code.

Summary Explanation/Background
On August 20, 2026, the Board directed the County Attorney’s Office to prepare an Ordinance changing the maximum rates that towing companies can charge for certain services. As directed by the Board, this Resolution would amend the Administrative Code to:
• Increase the annual escalator for nonconsent towing rates to the lesser of the Consumer Price Index (“CPI”) or 5% (currently the lesser of CPI or 3%);
• Provide a surcharge for electric vehicle storage due to fire risk; and
• Permit a fuel surcharge comparable to that permitted for taxicabs.
The Board’s fourth directive, to draft an Ordinance providing for background checks for towing company employees, is covered in a separate agenda item, which would amend the Broward County Code of Ordinances. That item also will include certain provisions related to the new storage fee for electric vehicles to ensure that the fee is applied fairly.
Timely notice has been published in accordance with statutory requirements to permit the Board’s consideration of the proposed Resolution.
