Why Action is Necessary
Motions A and B. Board of County Commissioners’ approval is required to amend Agreement language to be suitable for a Continuing Services Agreement.
What Action Accomplishes
Motions A and B amend the delegated authority provisions of each Agreement to be based on the value of individual Work Authorizations, including amendments, pursuant each Agreement.

PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.
On June 14, 2022, Item No. 63, the Board approved the Request for Proposals (RFP) solicitation for RFP No. PNC2124594P1, Consultant Services for Work of a Specified Nature, Continuing Term.
On December 13, 2022, Item No. 25, the Board approved the County Administrator to execute Agreements during the Board’s 2022/2023 Winter Recess (December 14, 2022, through January 24, 2023). Exhibit 1, Additional Material - Information included the Agreements between Broward County and Synalovski Romanik Saye, LLC and ACAI Associates, Inc. respectively. Each Agreement has a cumulative total of $3,750,000 and were executed by the County Administrator on January 19, 2023.
On June 13, 2023, Item No. 29, the Board approved the County Administrator to execute contract amendments during the Board’s 2023 Summer Recess (June 14, 2023, through August 22, 2023). Exhibit 1, 2023 Summer Recess Board Action List included Amendment No. 1 to the Agreements between Broward County and Synalovski Romanik Saye, LLC and ACAI Associates, Inc. respectively. Amendment 1 increased the cumulative not-to-exceed amount for Work Authorizations issued pursuant to each Agreement from $3,750,000 to $5,000,000, respectively. Amendment No. 1 with Synalovski Romanik Saye, LLC was executed by the County Administrator on August 21, 2023, and Amendment No. 1 with ACAI Associates, Inc. was executed by the County Administrator on August 18, 2023.
Motions A and B seek to amend the Agreements to adjust the authority of the Director of Purchasing to execute Work Authorizations and amendments in amounts between $50,000 and $500,000 for each Work Authorization, rather than per individual contract as originally approved, to facilitate the County’s ability to authorize the performance of Services in an efficient and timely manner, all in the best interest of the County.
The Amendments have been reviewed and approved by the Office of the County Attorney as to form.
