AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO TOWING AND IMMOBILIZATION SERVICES, AMENDING CHAPTERS 8½ AND 20 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Allows for the Board’s consideration of the proposed Ordinance amending the Broward County Code of Ordinances (“Code”).

Summary Explanation/Background
On August 20, 2026, the Board directed the County Attorney’s Office to draft amendments to the Code and the Broward County Administrative Code (“Administrative Code”) to make the following modifications to nonconsent towing rates and regulations:
• Increase the annual escalator for nonconsent towing rates to the lesser of the Consumer Price Index (“CPI”) or 5% (currently the lesser of CPI or 3%);
• Provide a surcharge for electric vehicle storage due to fire risk;
• Permit a fuel surcharge comparable to that permitted for taxicabs; and
• Require Level 1 background checks for towing company employees.
This Ordinance addresses the background checks and the conditions under which the surcharge will be authorized.
The rate changes are addressed primarily through a separate Administrative Code amendment.
Timely notice has been published in accordance with statutory requirements to permit the Board’s consideration of the proposed Ordinance.
