Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
On March 14, 2023, Enterprise Technology Services applied for the Florida Local Government Cybersecurity Grant (“Grant Program”) administered by the Florida Digital Service, on behalf of Enterprise Technology Services (“ETS”) and Water and Wastewater Services (“WWS”). On May 16, 2023, ETS was notified that the County was selected for participation in the Grant Program. On May 23, 2023 (Item No. 69), the Board authorized the County Administrator to negotiate, approve, and execute a grant agreement between Broward County and the State of Florida Department of Management Services for cybersecurity solutions, subject to review for legal sufficiency by the Office of the County Attorney.
The Broward County Aviation Department (“BCAD”) applied for the Grant Program in support of cybersecurity efforts at the Fort Lauderdale-Hollywood International Airport (“FLL”). On May 17, 2023, BCAD was notified that its grant proposal had been selected for participation in the Grant Program. On June 6, 2023 (Item No. 50), the Board authorized the County Administrator to execute a grant agreement between Broward County (acting by and through its Broward County Aviation Department) and the State of Florida Department of Management Services for a Florida Local Government Cybersecurity Grant, subject to review for legal sufficiency by the Office of the County Attorney, pursuant to which the Broward County Aviation Department will receive licenses, services, and training, through State selected providers, for cybersecurity solutions for Broward County’s Fort Lauderdale-Hollywood International Airport.
On or around May 13, 2024, ETS, WWS, and BCAD received notification from the State of Florida Department of Management Services that additional funding was available in support of the initiatives started with the initial grants. The deadline for acceptance of the additional grant funding and submission of the Grant Agreements is June 27, 2024.
As part of the proposed Grant Agreements, ETS, WWS, and BCAD will receive licenses, through a State selected provider, for certain cybersecurity solutions. This additional funding will continue to support cybersecurity initiatives for endpoint-based asset discovery, network-based asset discovery, external-facing asset discovery, endpoint detection and response, and security operations platform, including software and services associated with a Security Operations Center.
The proposed Grant Agreements are on the required form of the State of Florida Department of Management Services and contain nonstandard terms, including a right of termination by the State for County’s failure to implement the solutions; a requirement that the County indemnify the State from claims arising from intellectual property infringement; a requirement that the County notify the State within 24 hours of a data breach of certain data, and that the County is responsible for all costs associated with a breach of its systems; and a requirement that the County cooperate with and provide assistance to the State’s incident response support.
The proposed Grant Agreements have been reviewed and approved by the Office of the County Attorney.
